Indian Govt denies cession of Kachchatheevu to Sri Lanka

Katchatheevu 410px 30-08-13The Union government of India on Friday informed the Supreme Court that the question of retrieval of Kachchatheevu from Sri Lanka did not arise as no territory belonging to India was ceded to Sri Lanka.

Taking on record the Centre’s response to a writ petition filed by Tamil Nadu Chief Minister Jayalalithaa seeking retrieval of Kachchatheevu from Sri Lanka, a Bench of Justices B.S. Chauhan and S.A. Bobde posted the matter for final hearing after three weeks to enable Ms. Jayalalithaa to file her rejoinder.

Ms. Jayalalithaa, who filed the petition in December 2008 as AIADMK general secretary, sought a declaration as unconstitutional the 1974 and 1976 agreements between New Delhi and Colombo on ceding of Kachchatheevu, an island off the Rameswaram coast, to Sri Lanka.

Ms. Jayalalithaa said the island was historically part of the Ramnad Raja’s zamindari and later it became part of the Madras Presidency. The island was always of strategic importance and special significance for fishing operations in the area. In or around 1921, Sri Lanka started claiming territorial rights over the island without any justification and notwithstanding such claims it continued to be part of India. She highlighted the sufferings of fishermen from Tamil Nadu who inadvertently strayed into the island. Because of the hostile attitude of the Sri Lankan navy, fishermen feared to go fishing as they were either killed or taken into custody if they entered Kachchatheevu.

In its response, the Centre said the island was a matter of dispute between British India and Ceylon (Sri Lanka), and there was no agreed boundary. The dispute relating to the status of this island was settled in 1974 by an agreement and both countries examined the entire question from all angles and took into account historical evidence and legal aspects. This position was reiterated in the 1976 agreement.

It said: “no territory belonging to India was ceded nor sovereignty relinquished since the area in question was in dispute and had never been demarcated.” Therefore, the contention of Ms. Jayalalithaa that Kachchatheevu was ceded to Sri Lanka was not correct and contrary to official records.”

The Centre said as per the two agreements, no fishing rights in Sri Lankan waters were bestowed to Indian fishermen. Under the agreements “Indian fishermen and pilgrims will enjoy access to visit Kachchatheevu and will not be required by Sri Lanka to obtain travel documents or visas for these purposes. The right of access is not to be understood to cover fishing rights around the island to Indian fishermen.”

On the frequent incidents of firing against Indian fishermen by the Sri Lankan Navy and their arrest, the Centre said “the government has always taken up on a priority basis with Sri Lanka including at the highest levels any incident involving safety and security of Indian fishermen in the waters between two countries. Whenever Indian fishermen were arrested, the government of India intervened and got them released,” it said and sought dismissal of the petition as not maintainable.

Rathupaswala factory workers trapped

Rathupaswala 410px 10 30-08Reports say that the employees of Casino businessman Dhammika Perera's Rathupaswala Vinigross factory, have been threatened by the villagers.
The development promotion manager of the factory Mr. Pradeep Chandanarathna said that the villagers who have laid siege around the factory are not allowing its employees to go out.
He further said that there are 297 employees in the factory are still trapped in the factory since yesterday afternoon and and that 76 of them are women and there is one pregnant mother among them.
He said that when they had tried to go out of the factory yesterday evening, the villagers had assaulted them with rocks and stones.
He also pointed out that the drinking water rations inside the factory are going low.
He accused that although a group of employees had tried to complain the police but the officers did not accept their complaints.
The Vinigross factory, which was accused of mixing poison to the water used by 13 villages including Rathupaswala, opened up its operations once again yesterday (30) without any restriction by the Court.
Objecting this decision, the villagers have surrounded the factory and ven. Theripehe Siridhamma thero is preparing to a fast again.
At the moment a massive force of Police and STF officers have been deployed in the area.

South Korean PM meets Sri Lankan president on visit

S Korean PM 410px 31-08-13South Korean Prime Minister Chung Hong-Won met the Sri Lankan president for bilateral discussions on Friday during an official visit aimed at boosting relations and investment.

The three-day official visit from 28-30 August also saw the prime minister visiting new areas on development in the island including a visit to the freshly expanded Colombo port, which is now the deepest harbor in South Asia.

Chung and Rajapaksa discussed investment and trade opportunities, including the high number of Sri Lankan migrant workers in South Korea according to the President's Office.

On Thursday the South Korean prime minister signed an agreement that will enable Sri Lanka to use South Korean technology to protect its environment including water resources.

"The Korea- Sri Lanka Environmental Cooperation Forum also embodies with strong commitment and determination of the Korean government. Korea will share its knowledge on the management on environmental issues and will explore new avenues for further cooperation in this field. The companies that are present here already have ongoing environmental projects in Sri Lanka or have plans to," he told the gathering at the signing ceremony.

This is the first official visit of prime minister of the Republic of Korea since the establishment of diplomatic ties between the two countries in 1977.

The South Korean prime minister's visit is a direct follow-up to the discussions at a summit meeting held by the Sri Lankan President Mahinda Rajapaksa with his Korean counterpart during his state visit to Seoul in April 2012.

Pottu amman's German brother suddenly dies

Pottuamman 410px 31-08-13The elder brother of LTTE intelligence wing leader Pottu Amman, who had secretly arrived in Sri Lanka and resided in Jaffna, has died recently.

After the revelation of the death of this person, named Shanmugalingam Shivagnanakumar, a German citizen, the German Govt, through its embassy in Sri Lanka, has secretly taken away the dead body to Germany.

He had been residing in a house in Ariyalei, Jaffna for 2 months and during the questioning of the security forces, he had said that it was his ancestral home.

However, according to the security forces, this not the
ancestral home of Pottu Amman and they say that this person had tried to appropriate the property by force.

And on the 21st, he had died from a heart stroke, that happened when he was going in front of Nallur kovil, Jaffna in a foot cycle.

After the police inquiries his body has been brought to a well known florist in Colombo and then to the Airport to be taken to Germany.

It has now been revealed that he had been residing in Germany for a long time and had come to Sri Lanka with the intention of bringing along the rest of his family.

Shanmugaligam Sivashanker, better known as Pottu Amman, head of the LTTE Intelligence Unit (TOSI) and the Black Tigers (Karunku Puligal), is a secretive man, of whom nothing much is known about. Wanted by the Interpol for terrorism, he has been the mystery man of the LTTE. But no more. Sunday Standard is able to unravel the mystery, and expose the LTTE`s second in command in words and picture.

According to very reliable sources, Pottu Amman, born in the early 40s had joined the LTTE in the early 80s after a long stint abroad. His wife is from Sandiweli, near the Eastern University and they have two children, a girl and a boy.

He is said to have been in charge of the LTTE camps in Tamil Nadu costal area during the early days of the LTTE.

In 1985 he was kidnapped by PLOTE cadres in Mahalingapuram, Chennai; and was released in exchange for Kannan, abducted by the LTTE.

Source privy to LTTE inside information told the Sunday Standard that, `Pottu Amman`s life was more of a secret than Prabhakan`s. He headed all the operations outside the North and East parts and orchestrated many suicide attacks against the country`s political leaders and anti LTTE Tamil political party members.`

Schoolgirl K'napped, striped and photographed

Girl reped team 410pxA suspect who was arrested for abducting a 22 year old schoolgirl who was waling towards her examination centre to sit down for the Advanced level examination and harassing her by taking nude photos of her from a mobile phone, was sent to remand prison till the 11th September.

The suspect is a youth residing in Moratuwa. Police have discovered the mobile phone which has been used to take the naked pictures of the girl by force.

Preliminary police inquiries have revealed that the reason behind this was a love affair that has gone in facebook.

The suspect is also a father of one child.

In the quest to find the missing loved ones

Jaffna 410px 31-08-13Hundreds of people held candles and photographs of loved ones as they marched in Sri Lanka’s capital on Friday demanding that authorities provide information about relatives who were reported missing during the country’s civil war.

The vigil, marking International Day of the Disappeared, coincided with a visit by United Nations High Commissioner for Human Rights Navi Pillay to assess the government’s progress in investigating wartime abuses.

During the quarter-century civil war, which ended in 2009, an undetermined number of suspected rebels, journalists and activists were abducted by “white van squads” allegedly operated by pro-government paramilitaries. Many were never seen again.

Relatives say they also don’t know the whereabouts of family members who surrendered to the army at the end of the war.

Pillay, who ends her weeklong visit on Saturday, is to report to the U.N. Human Rights Council next month on the status of the investigation into abuses allegedly committed by government troops and separatist Tamil Tiger rebels, including abductions and forced disappearances.

Separately Friday, hundreds of people protested outside the country’s U.N. office, urging Pillay to probe alleged atrocities by the rebels.

About 500 people from the Dead and Missing Person’s Parents Front shouted slogans and held placards reading, “Ms. Pillay we are waiting 30 years for justice.”

The European Union, meanwhile, said it hopes that the government-appointed committee investigating disappearances “will approach its important and challenging task with determination and independence” and observe international standards.

The EU delegation in the country said in a statement that it “encourages Sri Lanka to draw on the support of international partners who may be able to assist with this challenging task.”

Couple found dead inside their shop

The bodies of a husband and wife were found inside their shop at the Kottamulla in Ratnapura today, Police said.
The bodies were recovered after a relative complained to the police that the couple had gone missing. Investigations revealed that residents in the vicinity had noticed their shop open the day before, but it was closed yesterday.
The police suspect foul play. The magisterial inquiry will be conducted today. (Lasantha Niroshan)

Import of vehicles: CB imposes 100% deposit requirement

The Central Bank has imposed a 100 per cent margin deposit requirement against the Letters of Credit opened with the commercial banks for the import of motor vehicles, other than buses, ambulances, lorries and trucks.

Issuing a statement, the Central Bank said:

The Central Bank has noted that, during the year 2013, the currencies of several trading partner economies have sharply depreciated against the Sri Lankan rupee. As a consequence, there has been a growing possibility that the importation of motor vehicles into Sri Lanka could accelerate in the period ahead. The Central Bank believes that this trend should not be allowed to continue without a suitable response.

In that background, in order to deal with the emerging risk, the Monetary Board at its meeting held on 27th August 2013 decided to impose a 100 per cent margin deposit requirement against the Letters of Credit opened with the commercial banks for the import of motor vehicles, other than buses, ambulances, lorries and trucks. Accordingly, Letters of Credit for the importation of specified vehicle categories could be done only with a minimum cash margin of 100 per cent, with immediate effect.

The Monetary Board has also decided to review the imposition of this margin after a period of six months.

Customs seize close to 100 kg of heroin

Close to 100 Kilogrammes of Heroin were seized by the Customs officials today at Orugodawatta.   

The officials said the heroin was found inside in a container packed as grease.

This is the largest stock of heroin to be detected in Sri Lanka

Weliweriya incident:top army officers relieved from posts

Army Commander Daya Rathnayake has ordered to relieve a Brigadier and three Lieutenant Colonels from their appointments to facilitate the further inquiries on the Weliweriya incident as recommended by the Court of Inquiry, the army announced.

Military Spokesman Brigadier Ruwan Wanigasooriya said that those officers have been placed under respective regimental centres pending further disciplinary proceedings.

1.    In connection to Weliveriya incident that took place on 1 Aug 13 where Army was called in to assist police to disperse violent mobs, the Commander of the Army has ordered to relieve four senior officers of the Sri Lanka Army from their duties with immediate effect.  They are the Brigadier who was in charge of the area and three Lieutenant Colonels who were his subordinate sector commanders.  They will be attached to respective Regimental Centres until further notice.

2.    Meanwhile the Director Legal, who is the Chief Prosecutor of the Army, examines the report of the Court of Inquiry further and will order a Summary of Evidence against any person who has violated the Military Law as a preliminary step of prosecuting such person through a Court Marshal.

3.    The Commander of the Army has also declared that the Army's assistance to the Police at Weliveriya has been only after a clear request made by the police and is well within the legal framework and is also in line with the provisions of the Public Security Ordnance.

4.    The Commander of the Army has also ordered all concerned to extend maximum possible cooperation, being a disciplined force, to carry out ongoing investigations by the Crime Detection Bureau as well as Hon Magistrate Court of Gampaha.  He has further directed to take action against military personnel according to the Army Act after the final outcome of the ongoing judicial process.

5.    A board of senior officers has been appointed to study the findings of the court of inquiry as well as other relevant reports/details and make recommendations as to how similar situations, particularly with regards to Army's involvement, could be averted in the future.

Northern Railway Line in Sri Lanka tested before next month`s opening


Sri Lanka Railways (SLR) authorities today conducted a test run on the Northern Railway Line which is currently being re-built from Vavuniya to Kankasanthurai, in Jaffna peninsula.

The train left the Omanthai railway station at 9.30 this morning and it reached Kilinochchi railway station at 10.10 a.m. Sri Lanka Railways sources said.

The train ran on the newly built track up to a speed of 100 km per hour.

The last passenger train on this line ran on January 19, 1985. Tamil Tiger terrorists bombed the Yal Devi train at Kokavil on that day killing 34 people and destroying the train tracks. The attack effectively ended the north-south rail transport.

Sri Lanka will officially launch the train service on the Northern Line up to the former rebel stronghold on September 14, Ministry of Transport announced.

President Mahinda Rajapaksa will launch the train service to Kilinochchi and he will also declare open the newly built Kilinochchi Railway Station.

Kilinochchi was the capital of the de facto state run by the Tamil Tiger terrorist outfit Liberation Tigers of Tamil Eelam. The Sri Lankan Army captured Kilinochchi in 2009.

Minister of Transport Kumar Welgama and other Ministers as well as the senior officials of Ministry and Sri Lanka Railway are to participate in the ceremony.

Sri Lanka`s Northern Line from Vavuniya to Kankasanthurai in the northernmost tip of the island was completely destroyed by the Tamil Tiger terrorists during the three-decade long war. The rebels uprooted the rail tracks to build reinforced underground bunkers.

The train line is now being reconstructed by the India Railway Construction International Ltd. (IRCON) with the assistance of the Indian government.

Currently the trains operate only to Omanthai, ten kilometers north of Vavuniya. The construction of the whole Northern Line up to Kankasanthurai would be completed by the end of 2014 and all the previous railway stations which were destroyed in the three decade war are to be reestablished, the Ministry says.

EU Parliament extols Lanka`s development process




The European Parliament has lauded Sri Lanka`s development process. Member of the MEP, UK, from the European Union Parliament Phil Bennion who is on a visit to Sri Lanka expressed this when he called on Economic Development Minister Basil Rajapaksa.

The Sri Lankan government which successfully faced the challenge of defeating LTTE terrorism has taken massive steps to develop the country, including the Northern and Eastern Provinces. Phil Bennion has said the international community can now witness for themselves the successful development process of Sri Lanka.

Leave Sanga alone


Our thoughts are with a certain cricket administrator who seems to be suffering from a sickness called Sadistic Personality Disorder. The symptoms of this sickness are callous, vicious, manipulative, and degrading behaviour expressed towards other people. Theodore Millon identified four subtypes of sadists. They are Explosive Sadist, Tyrannical Sadist, Enforcing Sadist and Spineless Sadist. Of these four types, Tyrannical Sadists are said to be deriving a special sense of satisfaction by forcing their victims who are either famous or popular by brutalizing them into submission . Star batsman Kumar Sangakkara seems to be his latest victim.

Sanga has been world s best cricketer for the last five years. It has been extremely satisfying to see him at that position, for one reason. He wasn t the most gifted batsman of his era, but sheer hard work has got him where he is. Sanga gives a sense of hope for those who aren t naturally gifted in their chosen profession. His message is that through hard work you can achieve your dreams.

Leave the cricket aside, the British would gladly embrace Sanga as one of their own for he would easily beat, say Alastair Cook or James Anderson if there were a contest on the works of William Shakespeare or Charles Dickens. Forget the cricketers, even David Cameron or Ed Miliband would be challenged. People have speculated many things for Sanga in post-retirement. We reckon Knighthood as one of the possibilities.

As much as his cricket, the Australians admire his sledging as well as the charity initiatives he has taken up. They see a bit of Steve Waugh in him. The world is in awe of Sanga, the cricketer, the speaker and the philanthropist. There are many facets to this great man. But sadly individuals at our own backyard seem to be deriving satisfaction by hurting and tarnishing the image of this iconic figure.

Today individuals who made a name for themselves because of cricket administration are gunning for, perhaps the greatest batsman the country has produced.

It s not just with cricket that Sanga has brought honour to the country. His stunning Cowdrey Lecture in 2011 saw a complete change of attitude towards the Asians at Lord s the Home of Cricket. For all its charm, tradition and history, Lord s can be a funny place. If your skin is dark, stewards tend to be rude, Oi! Where do you think you are going? was a common way of greeting the Asians. But that spellbinding speech by Sanga in that July evening changed things around completely. After Sanga s speech on Spirit of Cricket, there was a remarkable change in stewards attitude. Now they say, Excuse me sir, can I help you?

Cricket officials ways are mysterious. A month ago they were doing their utmost to safeguard a podian cricketer. They came up with the ridiculous story that the player was sleepwalking. But when it comes to an iconic figure which is Sanga, the same officials seem to be doing everything to project him in bad light.

Senior cricket officials yesterday tendered several apologies to Sanga for an effort by one of their own to tarnish his image. They felt the whole episode, on which franchise Sanga should play during the Champions League, has been badly handled.

It has to be noted here that Sanga is contracted to play for the country and not the domestic team. Another issue is that if the Sri Lanka Premier League (SLPL) had taken place, Sanga would have been eligible to play for a team managed by a foreigner comprising foreign players. It was not his fault that the SLPL got cancelled.

We would also like to mention here that Sanga since 2003 has foregone match fees and prize money for domestic cricket both club and provincial. This is due to the fact that he feels that domestic cricketers are paid a mere pittance and his earnings from domestic cricket go back to a pool to be shared by his club mates.

One administrator for quite some time has plotted kicking Sanga out of the national side together with another senior player. He has been putting pressure on the selectors to leave out the two senior players for international T-20s, but the selectors to their credit have resisted such moves saying they will pick players on merit alone.

We believe that Sanga should have the freedom to choose which team he will represent during the Champions League as it is a club tournament. However, we urge him to act with more responsibility in the future.

We expect him to lead from the front when the interests of Sri Lankan cricket are at stake in the future. Sadly, over the years his leadership on this matter has been extremely disappointing. He was one of the senior players who worked behind closed doors together with his agent Charlie Austin to cancel Sri Lanka s cricket tour of England in 2009. It was silly of him to take up several technical issues and delay his departure to England for Sri Lanka s tour of that country in 2011 again due to the IPL. From men like Sanga we expect more than that.

Train service to K chchi to resume after 23 years


Sri Lanka Railways would officially recommence the train service on the Northern line, up to Kilinochchi, after a lapse of 23 years, under the patronage of President Mahinda Rajapaksa on September 14, Department of Railways, Planning Director, Wijaya Samarasinghe said yesterday.

Currently, the trains operate only up to Omanthai, 10 km north of Vavuniya.

The Northern Line, from Vavuniya to Kankesanthurai, was destroyed by the Tiger terrorists during the three-decade-long war and the train service to Kilinochchi came to a halt in July 1990.

The army recaptured Kilinochchi in 2009.

All railway stations along the route destroyed in the three-decade war would be re-established, Samarasinghe said.

According to the Sri Lanka Railways, the reconstruction of the whole Northern Line, up to Kankasanthurai would be completed by the end of 2014.

`We have already completed several stations and train services will officially be launched next month,` he told The Island.

The train line is being reconstructed by the Indian Railway Construction International Ltd. (IRCON) with the assistance of the Indian government. This achievement of resumption of train service was made possible because of Indian financial aid and reconstruction efforts, Samarasinghe added.
